Dear Guest of the Franschhoek Wine Tram

*Indemnity: “By participating in the various activities and tours offered by Franschhoek Wine Tram (FWT),

(1) you acknowledge and accept the inherent risks associated with the activities and tours offered by FWT, potentially involving exposure to serious injury, accidents or death, and you accept that you and any minors under your care (your minors) participate in the activities and tours offered by FWT at own risk and you agree to take responsibility for your own and your minors’ safety and well-being while participating in these activities and tours;
(2) you undertake in your own capacity and on behalf of your minors, to indemnify and hold harmless, to the maximum extent permitted by law, FWT and its owners, employees, directors, sub-contractors, agents, representatives and service providers (Indemnified Parties), against any actions, damages (including consequential damages), claims, losses, expenses (including attorney’s fees on an attorney and own client scale) and other liabilities arising from or in connection to, or resulting from third party claims related to, any damage to person or property, theft, injury, paralysis, loss of limb, illness and/or death (i) which you or your minors may sustain for any reason (excluding as a result of any intentional or grossly negligent act or omission on the part of FWT) and/or (ii) of any person whatsoever, which any act or omission of yourself and your minors may cause (whether by intentional or negligent act or otherwise) to the Indemnified Parties during the course of the activities and tours offered by FWT.”

*The tour is monitored by video cameras for safety and security purposes.

Kindly take note of the following very important points:

The tour is strictly a wine tasting experience and does not host celebration events such as birthdays or bachelor/bachelorette parties. Unfortunately, we will not allow celebrations/parties on the experience as we are primarily a wine-tasting experience. Thus, no birthday celebrations or bachelor/bachelorette parties can be accommodated on our service.

No fancy dress/costumes or vulgar/insulting clothing will be allowed.

Be at the Ticket Office 15min before dep. time. Miss dep. time, no space on other time slots for day.

No refunds will be provided for unclaimed tickets on the day, please see our cancellation policy for more details.

Hand purchases to the host for sticker tracking; wine at the ticket office at journey end; no travel with purchases.

Ticket transfers can be facilitated based on the AVAILABILITY of the requested new date and or time slot, however, we can only transfer the date and time slot ONCE, thereafter the cancellation policy applies. Transfers can only be done 7 days prior to booking by sending an email to info@winetram.co.za.

Prohibited Items:
*Consumption of alcohol on the premises or in vehicles of FWT strictly prohibited, except for the complimentary taster received on the tram.
*Smoking and or consumption of cannabis is not permitted on FWT premises.
*No weapons or firearms are allowed on FWT premises.

CREDIT CARD PAYMENTS
For credit card payments, this is a confirmation of the reservation of your booking only but not proof of payment by the bank.
On the rare occasion that there has been a technical issue with the bank process and payment does not go through, our system will automatically pick this up on the date of departure when you present your booking ID confirmation at our ticket office.

Transfer Option:
*Please note transfer bookings to be made a minimum of 48 hours before your tour.
We now also offer exclusive transfers from Cape Town, Stellenbosch, Paarl and surrounds at very affordable rates which collects you at your specified address. Please see the zones below in terms of the collection areas included within our pricing structure.

CANCELLATION POLICY (All services including chauffeur/transfer services):
3 days + = 100% REFUND
Less than 5 days before scheduled TIME SLOT = No Refund

Please send a cancellation email to info@winetram.co.za including your booking ID on the subject to request a refund.

Detailed description of goods and/or services
Franschhoek Wine Tram is a business in the activity industry.
Return and Refunds policy
The provision of goods and services by Franschhoek Wine Tram is subject to availability. In cases of unavailability, Franschhoek Wine Tram will refund the client in full within 30 days.

Customer privacy policy
Franschhoek Wine Tram shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

Payment options accepted
Payment may be made via Visa, MasterCard credit cards or by bank transfer into the Franschhoek Wine Tram bank account, the details of which will be provided on request
Credit card acquiring and security
Credit card transactions will be acquired for Franschhoek Wine Tram via PayGate (Pty) Ltd who are the approved payment gateway. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer details separate from card details
Customer details will be stored by Franschhoek Wine Tram separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za

Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
Franschhoek Wine Tram takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
Country of domicile
This website is governed by the laws of South Africa and Franschhoek Wine Tram chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, enter your business address here .
Variation
Franschhoek Wine Tram may, in its sole discretion, change this agreement or any part thereof at any time without notice.
